 2010 TAX LIEN SALE INFORMATION

 

Clear Creek County Tax Lien Sale for 2009 taxes will be 11/05/2010 at the Georgetown Community Center located at 613 6th St.  in Georgetown, Colorado .   Please report to the Treasurer’s office in the courthouse first to register and pick up your buyer number for the sale. The delinquent tax list will be published in the Clear Creek Courant September 29th, October 6th,and 13th, 2010, and will be on the County web-site.  The web-site is updated as payments are received.  Please bring your listings with you for sale day as we will have limited copies available.

 

Registration

Buyer registration forms are available on our web-site and can be completed and mailed to the treasurer’s office prior to sale.  You may register for the sale at the treasurer’s office anytime prior to sale day or on the morning of the sale.

 

IRS Requirement

We are required by the Internal Revenue Service to issue 1099-Int forms to buyers who receive interest from tax liens.  You must complete a W-9 form at the time of registration in order to participate in our Tax Lien Sale.

 

C.R.S. 39-11-151

County Officials and employees may not acquire a tax lien or property by sale of a tax lien.  Therefore, employees and officials of Clear Creek County and members of their immediate family are not eligible to purchase at the Clear Creek County Tax Lien Sale.

 

Sale Day

The sale will begin at approximately 9:00 A.M.

Bidding starts at the amount of taxes, interest, advertising and fees due at the time of sale.  Any amount in excess of the advertised amount is called a “Premium”. 

Premium bids are normal for all properties in Clear Creek County and premium amounts are set by the buyers.  Please note that any premium you give over and above the amount due at the sale will not be recovered.  That is your cost once the property is redeemed.  Most properties in the county are redeemed within the first year.

 

Full payment is required immediately after the sale for liens purchased that day.  We will accept personal checks if you have pre-registered with the treasurer’s office and have been pre-approved prior to the sale.  We accept cash or cashiers checks but we do not accept credit cards for the sale.    This is a buyer beware situation so you must do your own research on the property that you will be bidding on.  Keep in mind that you are not purchasing an ownership interest in the property; you are purchasing a tax lien on the property.

 

 Interest Rate

The interest rate (established pursuant to C.R.S. 39-12-103) is established by adding nine percentage points to the federal discount rate as of September 1st and rounding to the nearest full percent.  If you purchase a tax lien, and it is redeemed the same month as the tax sale, you will receive one month’s interest.

 

After the Sale 

You will be issued a Tax Lien Sale Certificate of Purchase for each lien you purchase. These Certificates of Purchase are important documents.  We request that the original certificates be kept in our office.  We will provide a copy of each to the lien holder.  As liens are redeemed you will then receive a check from our office and should note that the certificate has been redeemed on your copy.

 

Sub Tax

Certificate Holders may pay subsequent year’s unpaid taxes for endorsement on to their Certificates.  These endorsements earn the same rate of interest as the original certificate from the date that you endorse them.  Notices are mailed to Certificate Holders in August of each year; however the owner may pay the current year taxes and not redeem the tax certificate.  This does not affect your certificate.

 

If you wish to transfer a certificate, you must do this by assignment on the back of the certificate.  If the transfer is to someone who is not registered as a buyer with the Treasurer’s Office, they must also come in and fill out the necessary paperwork.  Please remember to keep us informed of your current address.

 

If the property has not been redeemed within three (3) years from the date of the sale, the Certificate Holder may apply for a Treasurer’s Deed to the property.  You must submit a deposit for expenses and this process can take up to six months.  If the property is not redeemed a Treasurer’s Deed will be issued.  If the property is redeemed during this period, any expenses must be reimbursed by the person making the redemption.  You will not however, receive interest on the deed deposit money.

Application Information

 

The only person(s) who may apply for a
Treasurer's Deed is the holder of the Tax Lien Certificate

 
In accordance with CRS 39-11-120(1) and 39-11-128(1) (a), a Treasurer's Deed may be issued three years from the date of the original sale, after proper application and notification. For Mobile Homes without land, a Treasurer's Deed may be issued one year from the date of the original sale, upon proper application and notification.

How Do I Apply?

1.      Contact our office and request an application form at (303) 679-2353.

2.      Complete the treasurers deed application and return with the ORIGINAL tax certificate, (if you are not having it held in safekeeping with our office), and the application fee to our office at Clear Creek County Court House.

 

The application fee is for expense which includes, title search, advertising charges, mailing fees, posting fees and any additional charges accrued in procedures by statute for issuance of a Treasurer's Deed.

3.      The Treasurer's Deed process takes approximately 3 to 5 months, given no unforeseen problems.

4.      The Treasurer's Deed will be issued if redemption is not made prior to the execution date. The Treasurer's Deed is recorded with the Clear Creek County Clerk & Recorder.

Things to Remember:

The Treasurer's Deed will not be issued until ALL subsequent property tax liens are paid in full and fees paid.
If the certificate is redeemed prior to deed issuance, you will receive your investment, interest, and your application fee in full. However, no interest is earned on the application fee.
