     The powers and Duties of the Public Trustee are defined in Title 38 of Colorado Revised Statute.  These duties include executing Release Deeds of Trust and processing documents pertaining to foreclosures on property located in Clear Creek County.  The Public Trustee Office is located in the Courthouse with the Treasurer’s Office at 405 Argentine, Georgetown, Colorado.

RELEASE DEEDS OF TRUST * C.R.S. 38-39-102

     To execute a release of Deed of Trust, it is necessary to submit the following to the Public Trustee’s Office.

 

1.       REQUEST FOR RELEASE OF DEED OF TRUST FORM, signed by ALL holders of the Evidence of Debt or their attorney or Agent.  If signed by an agent it must so indicate on the Release form.  This request shall be duly executed and acknowledged.

 

2.      THE ORIGINAL EVIDENCE OF DEBT marked “Paid in Full” and signed by the holder or holders of the Evidence of Debt, or their agent.  If signed or marked paid by an agent it must so indicate on both the Evidence of Debt and release form.

 

If the Original evidence of Debt cannot be produced the Public Trustee may accept

A corporate surety bond issued by a company authorized to issue such bonds in the State of Colorado with the Public Trustee as Obligee, conditioned against the delivery of any such original Evidence of Debt to the damage of the Public Trustee and in a sum equal to one and one half times the original principal amount recited in the Deed of Trust.

A “qualified holder” as defined in section 38-38-100.3 may request the release of a deed of trust without producing the original evidence of debt.  Such “qualified holder” that requests the release of a deed of trust without producing the original evidence of debt shall be deemed to have agreed to indemnify and defend the public trustee against any claim made for damages resulting from the action of the Public Trustee taken in accordance with the request.

3.      The Originally Recorded Deed of Trust.   If this instrument is lost, a certified copy from the Clerk & Recorder’s Office, or a copy showing the recording information is acceptable.

 

      4.     A $26.00 Fee for execution AND recording a one (1) page standard release form ($5.00 for each  additional page). Please
              enclose a SASE in proper size to return documents.

 

 

FORECLOSURE SALES * C.R.S. 38-38-100.3

 

     The Clear Creek County Public Trustee holds foreclosure sales on Thursdays at ll: 00 A.M. at the office of the Treasurer and Public Trustee, 405 Argentine, Georgetown, CO   80444.

 

     Those interested in bidding must personally attend the sale.  If you cannot attend and wish someone to bid for you, we must have a letter of agency notarized pursuant to CRS 15-14-607. 

 

     We DO NOT take over bids by phone, fax or e-mail.

 

     If you intend to bid at a sale, please prepare in advance.  We cannot give legal advice and we do not know if the lien being foreclosed is a 1st Lien.  We also do not know if there are other liens on the property.

 

     You will need to show up a few minutes early on sale day to sign in and give us the necessary information.  We will expect you to have Certified Funds for $5.00 over the Lender’s bid amount.  If the bid should go higher, you will be given 4 hours to return with the additional “certified” funds.

 

     Lender bids will be available by 2:00 P.M. on Tuesdays before the sale, however, bids can be pulled and sales continued right up until sale time.

The  Foreclosure Process:

      1.  Notice of Election and Demand is recorded within 10 business days of receiving a

           packet from the lender’s attorney.

      2.  Sale date is set between 110-125 calendar days after the NED was recorded (non-ag).

Combined Notice is mailed within 20 calendar days after the NED was recorded.

Second Combined Notice is mailed with 45-60 calendar days prior to first scheduled sale date.

Combined Notice published in local paper 45-60 calendar days prior to the first scheduled sale date.

Notice of Intent to Cure must be received at least 15 calendar days prior to the first scheduled sale date.  A cure, in the form of a cashier’s check, must be paid by noon the day before the sale.

The court order authorizing the sale and the signed and itemized bid must be received by noon two (2) business days prior to sale day.  The Pre-sale List is made available by 2:00 p.m.

The sale is conducted at the Clear Creek County Courthouse, Office of the Treasurer & Public Trustee at 11:00 a.m.

The Certificate of Purchase is recorded within five (5) business days

A Notice of Intent to Redeem must be filed by a junior lienholder within eight (8) business days after the sale.  Foreclosures started in 2008 and newer do not allow for owner redemptions.
