Evictions
The following information is for informational purposes only and does not constitute legal advice about your case. Our intent is to provide the public with general guidelines as to the Clear Creek County Sheriff's Office procedures for serving and executing evictions within Clear Creek County. Forms and instructions for evictions and other Colorado civil legal process can be located at Colorado Judicial Branch website. (SFED) Summons in Forcible Entry and Unlawful Detainer
A Summons in Forcible Entry and Unlawful Detainer / Eviction is the summons that is obtained by the Plaintiff(s) (landlord) via the court requiring the Defendant(s) (tenant) to appear for a hearing to determine if the court shall order an eviction restoring possession of the premises (rental property) to the rightful owner (landlord). "Personal" service or service by "Posting" must be effected at least 7 calendar days before the Court date.

Our Requirements to Serve a (SFED)
  • Prepayment of Service/Mileage Fee - (see Civil Process Fees)
  • Determine "Type" Service Required - "Personal" or "Posting"
  • Provide Service Information- Defendant(s)/tenants name and address
  • Provide 2 copies of documents to be served
  • Provide Plaintiff(s)/landlords "Return of Service" Information
  • Provide Self Addressed Stamped Envelope for return of service

Writ of Restitution
A Writ of Restitution is the court order that instructs the Sheriff or his designee to physically remove the tenant and his property from the landlord's property. A Writ of Restitution is only valid for 49 days from issuance.

Our Requirements to Execute a Writ Of Restitution
  • Prepayment of Service/Mileage Fee - (see Civil Process Fees)
  • Provide 2 copies of documents to be executed
  • Provide "Return of Service" Information
  • Provide Self Addressed Stamped Envelope for return of service
  • The Eviction (lockout/removal) of a tenant will be scheduled once a deputy has "posted" a copy of the writ along with a warning notice from the Sheriff's Office.
  • Evictions are only scheduled on Tuesdays or Thursdays at 2:30 p.m. There may be a waiting period for the next available eviction date.
  • A deputy will stand by for up to 2 hours to keep the peace. A charge of $50 per hour will be charged for evictions lasting more than 2 hours.
  • The Sheriff's Office requires the landlord/agent be present at the scheduled time of eviction and must provide adequate manpower, supplies and services necessary to complete the eviction in 2 hours by removing all property from the dwellings and the property.
  • Under Colorado law, the deputy is immune from civil liability for any damage to a tenant's personal property that was removed. A landlord who complies with the lawful direction of the deputy executing the Writ is also immune from civil and criminal liability.

Cancellation Policy
A 12 hour notice must be given to cancel a scheduled eviction. If notice is not given, you will be charged a fee of $50 to cover processing, administrative costs and deputy call-in.

Payments
Payments can be made in Cash, Check, or Money Order and made payable to the Clear Creek County Sheriff's Office.  Electronic Checks and Credit / Debit Cards (Visa, MasterCard, American Express and Discover) are accepted online and over-the-counter with a service fee of 2.7%.
